REGISTRATION OF INTER VIVOS TRUSTS

After the recent changes to the Close Corporation Act, an Inter Vivos Trust may, effective from January 2006, own the members interest in a Close Corporation, subjected to certain rules and regulations.

Depending on the workload of the Master of the High Court, the registration of a Inter Vivos can vary between 6 to 8 weeks

bulletHowever, it is possible to register an Inter Vivos within 5 working days, if our corresponding attorneys take the documentation through the relevant processes. Our corresponding attorneys charge us an additional fee of R2850.00 for this special service, which we have to recover from you.
bulletRegistration of the Inter Vivos Trust as the member of your Close Corporation;

bulletRegistration of a new or an amendment to an existing Close Corporation (CC):
bulletNew CC - Name Reservation (CK7) - R165.00
bulletNew CC - Founding Statement (CK1) - R955.00
bulletExisting CC - Amended Founding Statement (CK2) - R660
bulletDepending on the workload of the Registrar of Close Corporations, the lodging of a :
bulletCK7 can vary from 2 business hours up to 7 business days;
bulletCK1 can vary from 1 business days up to 4 weeks;
bulletHowever, it is not possible to register a CK1 with a trust as the member within 1 day, because the electronic loading facility does not yet allow for a trust to be loaded as a member of the CC.
